Certainly here in Canada the houseowner is liable for injuries sustained by trespassers. We have a 15ft pit on our land (attempt to find water- but it's dry as a bone) and a visiting lawyer friend told us to fence it in so no one could fall into it. We could be sued if some trespasser hurt himself. We just have a small acreage, so it's not as if there are public footpaths near here. It's clearly private property.
